CarePAK PRO Extended Service Plan Terms & Conditions

purchased on or before May 31, 2018

A. ELIGIBILITY

This Canon CarePAK PRO Extended Service Plan (CarePAK PRO) is given by Canon U.S.A., Inc. (Canon), One Canon Park, Melville, NY 11747 [1-800-OK-CANON], as Obligor, with respect to the Canon brand peripheral product identified on your CarePAK PRO enrollment registration receipt (the "Covered Product") for which the CarePAK PRO has been purchased. CarePAK PRO must be purchased and registered while your Covered Product is still within its original warranty period. Canon reserves the right to verify product and warranty eligibility and may reject your enrollment. The purchase of the Extended Service Plan is not required either to purchase the Covered Product or to obtain financing for the Covered Product.

B. COVERAGE
  1. Coverage under this CarePAK PRO begins upon the acceptance of your CarePAK PRO enrollment registration, and is in effect for a period of two (2) years (for the One Year option), or for a period of three (3) years (for the Two Year option) from the original purchase date of your Covered Product. The term for each option referenced in the preceding sentence includes the one (1) year term of the limited warranty for your Covered Product You must have a valid CarePAK PRO enrollment number to obtain service for the Covered Product under the CarePAK PRO.
  2. There are two options for obtaining service under the terms of CarePAK PRO:
    1. Authorized Service Facility (ASF) Carry-In/Mail-In Service (available only through Canon USA's Authorized Service Facility network). See paragraph D.1. for details.
    2. InstantExchange Service** (available only in continental U.S., Alaska, and Hawaii). See paragraph D.2. for details.
  3. During the term of this CarePAK PRO, Canon agrees with the original purchaser to provide repair service for the Covered Product by repairing or replacing (at Canon's discretion) defective parts with new or comparable rebuilt parts. Alternatively, you may exchange a defective Covered Product with a comparable refurbished product through Canon's InstantExchange program. Repair, replacement or exchange under this CarePAK PRO shall not extend the term of this plan. There is no deductible.
  4. This CarePAK PRO is valid for repair service in the United States only, and is not transferable to any other person or entity.
  5. This Extended Protection (Service) Plan is not subject to renewal.
  6. The following is applicable to residents of Arkansas, Hawaii, Missouri, Montana, Nevada, North Carolina, Oregon, South Carolina, Vermont, Virginia and Washington only: This Extended Protection (Service) Plan is insured by a contractual liability insurance policy issued to Canon U.S.A., Inc. by Sompo Japan Insurance Company of America, 11405 N. Community House Road, Suite 600, Charlotte, NC 28277, 704-759-2200.
C. TECHNICAL SUPPORT

You may obtain technical support for a Covered Product under the CarePAK PRO at any time as follows:

  1. E-mail support via Canon's web site at pixmapro@cits.canon.com.
  2. Speak to a Canon Customer Care Center representative 24/7 (excluding Canon-observed holidays) at 1-855-380-6677.
  3. Telephone Device for the Deaf (TDD-1-866-251-3752).
D. OBTAINING SERVICE

To receive repair service for a Covered Product, call Canon's Customer Care Center at 1-800-828-4040. Have the serial number of the Covered Product and your CarePAK PRO enrollment number available when you make the call to expedite service. A Canon Customer Care Center representative will attempt to diagnose the nature of the problem and correct it over the telephone. If the problem cannot be corrected over the telephone, you will be asked to select from, and follow the applicable procedures for,

  1. ASF Program (Carry-In/Mail-In service) or (2) InstantExchange Service. PLEASE NOTE THAT YOU ARE LIMITED TO A MAXIMUM TOTAL OF TWO (2) SERVICE CLAIMS (FOR THE ONE YEAR OPTION) OR THREE (3) SERVICE CLAIMS FOR THE THREE (3) YEAR OPTION UNDER THIS CarePAK PRO. 1. ASF Program (Carry-In/Mail-In Service): Under the ASF Program (Carry-In/Mail-In Service) option, the defective Covered Product is repaired or exchanged, at Canon USA's option, by an Authorized Service Facility (ASF) and returned to you. If you elect this option, the Canon Customer Care representative will direct you how to obtain the name and phone number of the ASF(s) nearest to your location. You must contact an ASF to schedule the repair. If shipping is involved, it is your responsibility to properly package and send your Covered Product, with a complete explanation of the problem and a return address, to the ASF at your expense. DO NOT INCLUDE ANY OTHER ITEMS WITH THE COVERED PRODUCT. Eligible Covered Products will be repaired or exchanged and returned to you without charge by the ASF. Any product received by Canon or an ASF that is not covered by, or ineligible for coverage under, this CarePAK PRO will be returned to you unrepaired, or, at the discretion of Canon or the ASF, you may receive a written estimate of repair at such cost as Canon or the ASF may generally establish from time to time:
  2. InstantExchange Service: Under the InstantExchange service option within CarePAK PRO, a defective Covered Product is exchanged for a comparable refurbished product on an expedited basis. The replacement product is shipped usually the next business day via two day delivery service. If you elect this option, a reference number will be issued to you. You will be required to provide a ship-to location (street address only) for the replacement product. If (i) you do not return your defective Covered Product to Canon by the date and in the manner specified by Canon: or (ii) your Covered Product is not eligible for InstantExchange Service, you may be invoiced by Canon for full replacement cost of the Covered Product, and your CarePAK PRO may be cancelled. Canon will ship the replacement product and a prepaid return waybill to you at Canon's expense. You must return the Covered Product to Canon by following the included return shipping instructions. The exchanged product will be covered by the remainder of the CarePAK PRO.

NOTE THAT BY USING THE INSTANTEXCHANGE SERVICE OPTION, YOU WILL KEEP THE REPLACEMENT PRODUCT THAT IS SENT TO YOU. THE COVERED PRODUCT THAT YOU SEND TO CANON BECOMES THE PROPERTY OF CANON AND WILL NOT BE RETURNED TO YOU.

E. SERVICE LIMITATIONS

This CarePAK PRO covers defects encountered in normal use of the Covered Product, and does not cover the following:

  1. Loss of or damage to the Covered Product due to abuse, mishandling, improper packaging by you, alteration, accident, electrical current fluctuations, failure to follow operating, maintenance or environmental instructions prescribed in the Covered Product's User's Manual or service performed by other than Canon or an ASF.
  2. Service, repair or replacement necessitated by the use of parts or supplies (other than those sold by Canon), which damage the Covered Product or cause abnormally frequent service calls or service problems.
  3. Service, repair or replacement of the Covered Product if its serial number or dating has been altered or removed.
  4. Service, repair or replacement of any covers, lids or trim parts, or any consumable items. including without limitation, ink cartridges, ink tanks and disposable printheads.
  5. Preventive maintenance.
  6. Service, repair or replacement of any product, equipment or software that may be included with or connected to the Covered Product.
  7. On-site or in-house service or repair of the Covered Product.
  8. Service, repair or replacement of any product purchased or used outside of the United States. InstantExchange service is available only in the continental United States, Alaska and Hawaii.
  9. Use of parts, media, software or supplies (other than those sold by Canon USA), including non-Canon ink cartridges / ink tanks or refilled ink cartridges / ink tanks, that cause damage to the Product or cause abnormally frequent service calls or service problems.
F. LIMITATION OF LIABILITY

1. Upon purchasing this CarePAK PRO, the disclaimer of the implied warranties of merchantability and fitness for a particular purpose included with your original limited warranty for the Covered Product may no longer be effective. In any event, the implied warranties will not last longer than the term of this CarePAK PRO.

CANON SHALL NOT BE LIABLE FOR LOSS OF REVENUES OR PROFITS. INCONVENIENCE. EXPENSE FOR SUBSTITUTE EQUIPMENT OR SERVICE, STORAGE CHARGES, LOSS OR CORRUPTION OF DATA. OR ANY OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE OR MISUSE OF, OR INABILITY TO USE, THE COVERED PRODUCT, OR FAILURE TO PROPERLY OR IN A TIMELY MANNER SERVICE THE COVERED PRODUCT, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, AND EVEN IF CANON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL RECOVERY OF ANY KIND AGAINST CANON BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE COVERED PRODUCT SOLD BY CANON WHICH CAUSED THE ALLEGED DAMAGE. WITHOUT LIMITING THE FOREGOING, YOU ASSUME ALL RISK AND LIABILITY FOR LOSS, INJURY OR DAMAGE TO YOU AND YOUR PROPERTY AND TO OTHERS AND THEIR PROPERTY ARISING OUT OF THE USE OR MISUSE OF, OR INABILITY TO USE, THE COVERED PRODUCT NOT CAUSED DIRECTLY BY THE NEGLIGENCE OF CANON. (SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION OR LIMITATION MAY NOT APPLY TO YOU).

G. ABILITY TO CANCEL AND RIGHT TO REFUND
  1. You may cancel the CarePAK PRO for a full refund within thirty (30) days of the original date of purchase of the CarePAK PRO if you have made no service claims. To cancel, send a written notice of cancellation. which includes your name, address, daytime phone number and your Canon CarePAK PRO enrollment letter, to Canon at: Canon CarePAK Extended Service Plan, ITCG Customer Support Operations Division, One Canon Park, Melville, NY 11747-3036.
  2. HAWAII, NEVADA, AND SOUTH CAROLINA RESIDENTS ONLY: You may cancel this CarePAK PRO at any time for any reason by sending a written notice of cancellation, which includes your name. address, daytime phone number, and your Canon CarePAK PRO enrollment letter, to Canon at: Canon CarePAK Extended Service Plan, ITCG Customer Support Operations Division, One Canon Park, Melville, NY 11747-3036. Canon may cancel this CarePAK PRO if you fail to pay, make a material misrepresentation or substantially breach your duties under this CarePAK PRO. The cancellation of this CarePAK PRO is not effective until at least fifteen (15) days after the notice of cancellation is mailed to you. If this CarePAK PRO is cancelled by you or Canon within sixty (60) days of the date of purchase, Canon will refund the entire amount you paid for the CarePAK PRO. If this CarePAK PRO is cancelled thereafter by either party, Canon will refund the entire amount you paid allocable to the remainder of the term of this CarePAK PRO prorated on a monthly basis.
  3. WASHINGTON RESIDENTS ONLY: You may cancel this CarePAK PRO at any time for any reason by sending a written notice of cancellation, which includes your name, address, daytime phone number, and your Canon CarePAK PRO enrollment letter, to Canon at: Canon CarePAK Extended Service Plan, ITCG Customer Support Operations Division, One Canon Park, Melville, NY 11747-3036. Canon may cancel this CarePAK PRO if you fail to pay, make a material misrepresentation or substantially breach your duties under this CarePAK PRO. The cancellation of this CarePAK PRO is not effective until at least twenty-one (21) days after the notice of cancellation is mailed to you. If this CarePAK PRO is cancelled by you or Canon within sixty (60) days of the date of purchase, Canon will refund the entire amount you paid for the CarePAK PRO. If this CarePAK PRO is cancelled thereafter by either party, Canon will refund the entire amount you paid allocable to the remainder of the term of this CarePAK PRO prorated on a monthly basis.
  4. OREGON RESIDENTS ONLY: Should Canon fail to perform as agreed under this CarePAK within 60 days of your request for service, you may contact Sompo Japan Insurance Company of America at the address/telephone number above to obtain reimbursement or service, pursuant to terms and conditions of Canon's contractual liability insurance policy. You may cancel this CarePAK PRO at any time for any reason by sending a written notice of cancellation, which includes your name, address, daytime phone number, and your Canon CarePAK PRO enrollment letter, to Canon at: Canon CarePAK Extended Service Plan, ITCG Customer Support Operations Division, One Canon Park, Melville, NY 11747-3036. Canon may cancel this CarePAK PRO if you fail to pay, make a material misrepresentation or substantially breach your duties under this CarePAK PRO. The cancellation of this CarePAK PRO is not effective until at least thirty (30) days after the notice of cancellation is mailed to you. If this CarePAK PRO is cancelled by you or Canon within sixty (60) days of the date of purchase, Canon will refund the entire amount you paid for the CarePAK PRO. If this CarePAK PRO is cancelled thereafter by either party, Canon will refund the entire amount you paid allocable to the remainder of the term of this CarePAK PRO prorated on a monthly basis.
  5. NORTH CAROLINA AND OKLAHOMA RESIDENTS ONLY: After the first thirty (30) days from the original date of purchase, you may cancel the CarePAK PRO by sending a written notice of cancellation, which includes your name, address, daytime phone number, and your Canon CarePAK PRO enrollment letter, to Canon at: Canon CarePAK Extended Service Plan, ITCG Customer Support Operations Division, One Canon Park, Melville, NY 11747-3036. If you have made no service claims, you will receive a pro rata refund of the purchase price of the CarePAK, less a cancellation fee equal to 10% of the price of the CarePAK PRO. In addition, FOR RESIDENTS OF NORTH CAROLINA ONLY, if you have made a service claim, you will receive a pro rata refund of the purchase price of the CarePAK PRO, less the value of any claims you have made under the CarePAK PRO, and less a cancellation fee equal to 10% of the price of the CarePAK PRO.
  6. CALIFORNIA RESIDENTS ONLY: You may cancel the CCESP by sending a written notice of cancellation, which includes your name, address, daytime phone number and your Canon Care enrollment letter, to Canon at: Canon CarePAK Extended Service Plan, ITCG Customer Support Operations Division, One Canon Park, Melville, NY 11747-3036. Upon such cancellation, you will have the following right to a refund of the purchase price of the CCESP: Cancellation within thirty (30) days of your receipt of the CCESP: a full refund, less the value of any service claims you made. Cancellation after thirty (30) days of your receipt of the CCESP: a pro-rated refund, less the value of any service claims you made and a cancellation fee of 10 percent (10%) of the purchase price or $25.00, whichever is less.

7. CANON OFFERS NO RIGHT TO CANCEL THE CarePAK PRO FOR A REFUND EXCEPT AS SET FORTH HEREIN.

H. ALTERNATIVE DISPUTE RESOLUTION
  1. There is no informal dispute settlement process established under this CarePAK PRO.
  2. CONNECTICUT RESIDENTS ONLY: If you are not able to resolve a dispute involving service under this CarePAK PRO, you are entitled to mediation through the office of the Insurance Commissioner. In order to initiate mediation, mail a letter containing a summary of the dispute, the purchase price of the Covered Product and the estimated cost of repair along with a copy of this contract to: State of Connecticut, Insurance Department, Attn: Consumer Affairs. P.O. Box 816, Hartford, CT 06142-0816.
